A spent conviction allows certain criminal convictions to be removed from a person’s criminal record for most purposes. Once a conviction is declared spent, it generally does not need to be disclosed in many situations such as employment applications.
Under the Spent Convictions Act 1988 (WA), a person may apply to have an eligible conviction declared spent after a prescribed period has passed and provided no further convictions have been recorded during that time.
Gunning Young advises and assists clients in determining whether they are eligible to apply for a spent conviction and prepares applications to the Commissioner of Police where appropriate.
Having a conviction declared spent can assist individuals in moving forward without the ongoing impact of a past offence on employment and other opportunities.
